Terms and Conditions (GTC)

§ 1. Introduction
 

By booking accommodation, the customer agrees to the following General Terms and Conditions. The booking is binding and requires written confirmation from the landlord.
 

These General Terms and Conditions apply to contracts for the rental of holiday apartments for accommodation purposes and all other services and deliveries provided by Montepaone Apartments to the guest. The services of Montepaone Apartments are provided exclusively based on these General Terms and Conditions.
 

The guest's terms and conditions will only apply if they have been agreed upon in advance. Deviations from these conditions are only effective if expressly confirmed in writing by us.

 

§ 2. Booking/Booking Confirmation

 

All booking requests must be made via our website, by email at montepaone_apartments@gmx.net, or by phone. Requests made through any other methods will not be considered.

If we can offer you the holiday apartment for your desired period, we will send you written confirmation and the invoice by email or post. Your booking becomes legally binding upon receipt of the booking confirmation and after making the deposit payment (see § 3 Payment Conditions).

§ 3. Payment Conditions

 

Payment for booking our holiday apartments is due immediately upon confirmation of the reservation. Payment can be made by bank transfer or PayPal. Please note that the booking is only confirmed once the payment is received. For bank transfers, please use the bank details provided in the booking confirmation and include the booking number in the payment reference. Payments via PayPal should be directed to the email address provided in the booking confirmation. Please note that any fees for payment processing are your responsibility. We reserve the right to cancel bookings if payment is not received. If payment deadlines are not met, the landlord may withdraw from the contract. Non-payment is considered a cancellation and allows for re-rental. No additional charges for water, parking, waste, or energy costs will be incurred.

§ 4. Arrival/Departure
 

​

On the day of arrival, the holiday apartment is available from 4:00 PM. For arrivals after 10:00 PM, a surcharge of 20 euros will be charged. Information about key collection will be provided to the guest 7 days before arrival, either by phone or email. Claims for damages cannot be made if the holiday apartment is not available precisely at 4:00 PM.

On the day of departure, the apartment must be vacated by 10:00 AM. If the guest desires a late departure, this must be arranged with us in advance. A late departure without prior arrangement will be charged.

If the guest does not appear by 11:30 PM on the day of arrival, the contract will be considered terminated after a period of 48 hours without notification to Montepaone Apartments. Montepaone Apartments or our representative will then be free to dispose of the property. A (partial) refund of the rental price due to early departure will not be given.

The apartment must be left in a broom-clean condition on the day of departure. Dishes, glasses, etc., must be washed and put away, trash bins emptied, and the refrigerator cleared out. Failure to leave the apartment as required may result in additional charges.

§ 5. Holiday Apartments

The holiday apartment will be handed over to you in a clean and orderly condition with complete inventory. Should you notice any defects during your stay, the guest is obliged to notify Montepaone Apartments immediately. The guest is liable for any damage caused to the rental property or its inventory, such as broken dishes, damage to floors, or furniture. This also includes the cost of lost keys.

The inventory should be treated with care and is intended only for use in the holiday apartments. Moving furniture, especially beds, is prohibited. The guest is also liable for the actions of their fellow travelers. Damages caused by force majeure are excluded. In the case of improper use of the holiday apartment, such as subletting, over-occupancy, disturbance of the peace, etc., the contract may be terminated without notice, and the guest must vacate the apartment. The rental fee already paid will remain with Montepaone Apartments.

§ 6. Stay

The holiday apartment may only be used by the persons listed in the booking. If the apartment is used by more people than agreed upon, an additional fee of 150 euros must be paid. Montepaone Apartments also reserves the right to terminate the contract without notice in such cases.

Subletting and transferring the apartment to third parties is not allowed. The guest agrees to the General Terms and Conditions as well as the house rules of the holiday apartments. Agreement is confirmed upon payment.

In the event of violations of the GTC or the house rules, Montepaone Apartments has the right to terminate the rental agreement immediately and without notice. There is no legal claim to a refund of the rental price or compensation.

§ 7. Cancellation

​
 

You may cancel the contract at any time. Cancellation must be made in writing. In the event of cancellation, you are obliged to compensate us for the damage incurred: from the day of booking confirmation by the landlord until the 30th day before the start of the rental period, you will receive a full refund. For cancellations less than 30 days before the start of the rental period, the full rental price must be paid. The date of receipt of your cancellation notice will be decisive. Amounts already paid will be offset. You may provide a substitute person who meets the specified conditions to take over your contract. A written notification will suffice.

§ 8. Cancellation by the Landlord

In the event of a cancellation on our part due to force majeure or other unforeseeable circumstances (such as accidents or illness of the hosts) or other circumstances beyond our control that make fulfillment impossible, liability is limited to the refund of costs. In the event of a justified cancellation, the customer is not entitled to any compensation claims—liability for travel and hotel costs will not be assumed. Montepaone Apartments may terminate the contract without notice after the rental period has begun.

§ 9. Landlord's Liability

​
 

Montepaone Apartments is liable within the scope of due diligence for the proper provision of the rental property. Liability for possible outages or disruptions in water or electricity supply, as well as events and consequences due to force majeure, is excluded.

§ 10. Risks of Using WLAN, Limitation of Liability

​
 

The guest is informed that the WLAN only provides access to the internet; virus protection and firewall are not available. Data traffic generated using the WLAN is unencrypted and can therefore be viewed by third parties. Montepaone Apartments explicitly points out that there is a risk of malware (e.g., viruses, trojans, worms, etc.) infecting the end device when using the WLAN. The use of the WLAN is at the guest's own risk. We accept no liability for damages to the guest's digital media caused by using the internet access unless the damages were caused by us or our agents intentionally or through gross negligence.

§ 11. House Rules, General Rights and Obligations



(1) The guest is obliged to comply with the house rules. Quiet hours are from 10:00 PM to 6:00 AM. To avoid disturbances, TV and audio devices should be set to room volume.


(2) During the rental period, the guest is obliged to keep windows and doors closed when leaving the holiday apartment.


(3) Smoking is generally prohibited in the holiday apartment. In case of violations, a cleaning fee of up to 100 euros may be charged. Smoking is only allowed on balconies and terraces.


(4) Our private parking lot offers 1 parking space per car. Additional vehicles can be parked on the street. Please ensure that no vehicles block the exit.


(5) The installation or attachment of materials for decoration or similar is not allowed in the holiday apartment. The guest is solely responsible for any decorations or similar installed or attached. The guest is also liable for any damages caused by the installation or attachment of decorations or similar.


(6) Montepaone Apartments has the right to access the holiday apartment at any time, especially in cases of imminent danger. The guest's privacy interests will be reasonably considered when exercising the right of access. We will inform the guest in advance about exercising the right of access unless it is unreasonable or impossible under the circumstances.

§ 12. Tourist Tax

​
 

We would like to inform you that a tourist tax of 2 euros per day and person is levied according to local regulations. This fee supports the maintenance and promotion of tourist infrastructures, recreational facilities, and other services that enhance your stay in our community. The tourist tax is charged per overnight stay and applies to all persons aged 14 and over. Children and adolescents under 14 years are exempt from the tourist tax. Please note that the tourist tax is not included in the accommodation price and must be paid separately on site.

§ 13. Special Requests and Side Agreements

 

Are generally possible. They require the landlord's written confirmation. Pets are generally prohibited. If animals are accommodated without prior consent from the provider, a cleaning fee of up to 100 euros may be charged.

§ 14. Data Protection

 

The tenant agrees that personal data necessary for the contract may be stored, modified, and/or deleted. All personal data will be treated with strict confidentiality.

 

§ 15. Liability

 

The listing was created to the best of our knowledge. There is no liability for impacts on the rental property due to force majeure, country-specific power and water outages, and weather. Likewise, no liability is assumed for unforeseeable or unavoidable circumstances such as official orders, sudden construction sites, or disturbances due to natural and local conditions. The landlord is happy to assist with resolving problems (as far as possible). The landlord assumes no liability for the use of provided play and sports equipment. The tenant's arrival and departure are at their own responsibility.

 

§ 16. Final Provisions

 

Photos and texts on the website or in the flyer serve realistic descriptions. A 100% match with the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings (e.g., furniture), provided they are of equal value. Should one or more provisions of these terms and conditions be or become invalid, this does not affect the validity of the remaining conditions. The invalid provision shall be replaced by a valid one that comes closest to the economic and legal intent of the contracting parties. German law applies. The place of jurisdiction and fulfillment is the place of residence.
